ベルギーにおける解散請求

簡単にまとめます。

ベルギーにおいて、○○真光は金銭の扱いに関する不透明さ（着服、横領、使い込みなどの疑い）から、非営利団体ではないとの疑いをかけられ、検察から出頭を命じられた(1997年5月29日）。検察は、非営利団体としての○○真光は解散して財産を清算するべきだと要求した。しかしながら裁判所は、検察が疑う理由は認められるが、確証がないということで検察の訴えを退け（1999年9月7日）、検察は控訴を断念した（1999年10月6日）。

The Public Prosecutor v. Sukyo Mahikari - Case closed HRWF (10.10.1999) -

　The non-profit making organisation Sukyo Mahikari in Belgium was summoned by the Public Prosecutor on the 29th May 1997 in the following terms: "whereas it results from the evidence heard (...) that the Belgian members of the Board of Directors have accepted to be appointed to their posts by pure connivance and have failed to exercise their functions, the Public Prosecutor demands the dissolution of the non-profit making organisation and the designation of a liquidator".

The case was heard on the 7th June 1999, but as the Public Prosecutor failed to present his conclusions, the other side did not present its case to combat the allegations.

In his judgment of the 7th September 1999 the Judge stated that "the claim against the organisation Sukyo Mahikari is admissible and allowable but unfounded".

The Public Prosecutor confirmed on the 6th October 1999 that it was not intending to appeal against that judgment.
